1. Agreements


1.1 Holiday home:

A holiday home is a house that is used as a recreation or holiday residence. A holiday home can have many forms, e.g. Bungalow, villa, chalet, apartment, studio flat, farmhouse, coach house, country house, water-mill, castle or a house in a holiday park. Residences which are meant for permanent use, as well as caravans and mobile homes are not covered by this agreement.

1.2 Application:

An application is only recognized when, via the website, all contact details are filled in and sent to Atrium Exchange. As soon as Atrium Exchange receives the application, this will be confirmed by email.

1.3 Membership:

Membership begins the moment Atrium Exchange receives the application.

1.4 Annual membership:

Membership fees will be due from the 1st day of the month of application. If the application is received on or before the 15th of the month, then membership fees will be backdated to the 1st of that month. If the application is received after the 15th then membership fees will be due from the 1st day of the following month.

Example:

If your application is received on the 12th of August, you will be a member from that date. Your annual payments will be due from the 1st of August. If your application is received on the 17th of August your annual payment will be due on the 1st of September.


1.5 Member:

Someone who is accepted as member by Atrium Exchange.

2. Membership 

2.1 To qualify for membership you need to be the registered owner of the holiday home.

2.2 Membership from Atrium Exchange is for the period of one calendar year and will automatically be renewed without notice every year.
2.3 Membership entitles you to:

· Advertise your property on the website of Atrium Exchange.
· Advice on exchanges.
· Unlimited exchange appointments during your membership period.
· Unlimited free online updates for your web advertisement.

2.4 Atrium Exchange expects all members to submit accurate descriptions of their property and to take the utmost care to be honest and truthful when compiling this information. By submitting this information to Atrium Exchange you automatically give your permission to place it on their website.

2.5 The placing of advertisements for properties not owned by members is strictly forbidden.


2.6 It is forbidden to advertise your property to rent, sell or any other commercial activity on the Atrium Exchange website.

2.8 Atrium Exchange retains the right to increase the annual membership fee. Members will be informed, in writing via the email of an increase a minimum of 2 months before the due date of their annual payment. Members have the right at this point to cancel their membership, see point 4: ‘cancellation of membership’.

2.9 Atrium Exchange retains the right to use any or all of your placed advertisement photographs for promotional material.

2.10 Atrium Exchange retains the right to without notice, edit, delete or alter any text or photographs placed by members on their website. This may occur for the following
reasons:

· When holiday homes are advertised to rent.
· Commercial use of the property is offered.
· The text/photographs do not accurately represent the property


3. Payment

3.1 The annual membership fee can be paid through various methods;

· Direct debit
· Bank Cheque
· Online via Ideal or Paypal
· Cash
· Credit card

3.2 Payment of the annual membership fee must be received by Atrium Exchange on or before the first day of the new membership.

3.3 New members can only place their advertisements for their property after payment of the annual membership fee has been received by Atrium Exchange.

3.4 In the event that payment is late or not received, Atrium Exchange retains the right to temporarily remove advertisements from their website. In this event the monies owed still need to be paid in full.

4. Cancellation of membership.

4.1 Cancellation of membership can only be accepted in writing via email.

4.2 The cancellation period is a minimum of 4 weeks before the renewal date. All cancellations will be confirmed via email by Atrium Exchange. If confirmation is not received it is the duty of the member to contact Atrium Exchange for more information regarding the situation.

4.3 In the event that the member removes his/her advertisement from the website without following the correct membership cancellation procedure as laid out in points 4.1 and 4.2 said member is still deemed to be a member and therefore all payments due remain in effect.

5. Gentlemen’s agreement

5.1 Members offer the hospitality of their holiday home and enjoy the hospitality offered in someone else’s holiday home. This hospitality happens behind closed doors. Theexchanged home is expected to be clean and in good repair when the visitors arrive. Equally the property and contents needs to be in the same state when the visitors leave. Atrium Exchange expects that their members respect the property of another. If there are any breakages, damage to the property or contents during the period of the stay, then these must be repaired or replaced. Members are personally responsible for their own property and contents and need to have the correct insurances to cover these.

5.2 The registered member of Atrium Exchange must be a member of the group in any exchange, unless that has been previously agreed in writing with the other exchange
party.

5.3 The registered member of Atrium Exchange is ultimately responsible for every exchange he/she takes part in.

5.4 When an exchange between two members of Atrium Exchange is agreed, the agreement is solely between the two members. Atrium Exchange is not party to any exchange agreement.

5.5 Members who make use of the services offered by Atrium Exchange for exchange agreements, should be aware of contract forms provided.

5.6 Exchanges can be evaluated by the members after the holiday and sent to Atrium Exchange. The references that are received by Atrium Exchange are always available for members upon request.

5.7 The user name and password given to the members are to be used only by that member. Failure to abide by this Gentleman’s agreement and/or proven complaints against a member can lead to instant exclusion of membership, without a refund of all, or part, of the annual fee.

6. Guarantees and responsibilities.

6.1 Atrium Exchange does not give any guarantees with regard to successful exchanges made by their members. Atrium Exchange is not responsible for the accuracy of the text and photographs used in advertisements on their website. Atrium Exchange is not responsible for the conduct of the members, members guests or pets during any exchange and is not liable for any damage caused by them in the accommodation.

6.2 The contract that Atrium Exchange enters into with its members is subject to the Dutch law and to the Magistrate in the County Court where Atrium Exchange is located.

7. General terms and conditions

7.1 Atrium exchange reserves the right to amend these conditions when necessary. Members will be advised of all amendments in writing via email. In the eventuality that a member is not in agreement with an alteration to the conditions they are free to cancel their membership in writing. The cancellation must be received within 6 weeks period after the alteration to qualify.
